IMPORTANT NOTICE: PLEASE READ THESE TERMS OF SERVICE CAREFULLY—THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS, AND INCLUDE WAIVERS OF RIGHTS AND LIMITATIONS OF LIABILITY. I. INTRODUCTION

Welcome to Star Path, an AI-powered astrology web app (and future mobile app) provided by Lionheart Software LLC dba Star Path (“Star Path,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our Services, including our website and any future mobile applications. By using our Services, you agree to these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must cease all use of the Services.

II. DEFINITIONS

  • “Star Path” means the service provided by Lionheart Software LLC dba Star Path.
  • “Services” means the Star Path website and any current or future mobile applications, including all features, tools, readings, and content provided by Star Path.
  • “AI Readings” means the personalized, AI-generated astrological insights and responses provided by our “oracle.”
  • “User Data” means any information you provide to generate your astrology chart, including but not limited to your birth date, time, and location.
  • “Subscription” means any recurring payment plan that grants you access to premium content or features, processed via our website.
  • “Content” means any text, graphics, images, videos, software, and other materials available through the Services.
  • “You” or “User” means the individual or entity accessing or using the Services.

III. YOUR RELATIONSHIP WITH US

A. What You Can Expect from Us

Services Provided.
Star Path offers personalized, AI-powered astrology readings (“AI Readings”) that function as an “oracle” to answer your questions in real time. We continuously update and improve our Services and reserve the right to modify or discontinue any aspect of the Services at our sole discretion. Significant changes that impact your use will be communicated to you if possible.

Updates and Amendments.
We may update these Terms from time to time. Your continued use of our Services following any changes will constitute your acceptance of the new Terms. If you do not agree with any changes, please stop using the Services immediately.

B. What We Expect from You

Accurate Information.
You agree to provide accurate and complete information when using our Services. Your User Data is used solely to generate your personalized astrology chart and readings.

User Conduct.
You agree to use the Services responsibly and in accordance with all applicable laws. You must not engage in any conduct that could harm the Services or other users. Prohibited activities include, but are not limited to:

  • Unauthorized copying, distribution, or modification of any Content.
  • Attempting to reverse engineer or disable any technological measures on the Services.
  • Using automated systems or software to extract data or interfere with the operation of the Services.

IV. USING THE SERVICES

A. Eligibility and Age Requirements

B. Account and Security

C. Subscriptions and Payments

Payment Processing.
Subscriptions are processed exclusively through our website using Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis in accordance with your subscription plan.

Recurring Billing and Refunds.
Your Subscription will automatically renew at the end of each subscription period. You may cancel your Subscription at any time, but no refunds will be provided for fees already paid. Changes in pricing will be communicated in advance and will apply to future billing cycles.

D. AI Readings and Disclaimers

Nature of the AI Readings.
Star Path provides AI Readings that combine astrological data with AI-generated insights. These readings are for informational and entertainment purposes only. Their accuracy is influenced by the information you provide and the inherently interpretive nature of astrology.

Disclaimer of Accuracy and Substitutive Value.

  • Accuracy: The AI Readings may occasionally be inaccurate or imprecise. Astrology is an art rather than a science, and variations in context provided by you may affect the output.
  • No Substitute for Professional Advice: The Services are not a substitute for professional advice (medical, legal, financial, parenting, etc.). You should not rely solely on our AI Readings for making major life decisions.
  • Assumption of Risk: You acknowledge that your use of the AI Readings is at your own risk, and Star Path shall not be liable for any errors, omissions, or consequences arising from reliance on the AI-generated content.

V. PRIVACY & DATA COLLECTION

We collect your User Data (e.g., birth information) solely for generating your astrology chart and providing personalized AI Readings. We secure this information in a GDPR-compliant manner and do not share it with any third parties. Please refer to our Privacy Policy for further details on data collection, storage, and your rights regarding your personal information.

VI. INTELLECTUAL PROPERTY

Our Content.
All Content provided by Star Path is owned by us or our licensors. You are granted a limited, non-exclusive, revocable license to use the Content solely for your personal, non-commercial use in connection with the Services.

User Content.
You retain ownership of any content you submit (“Your Content”), but by submitting, you grant Star Path a worldwide, non-exclusive, royalty-free, irrevocable license to use, modify, and distribute Your Content in connection with the Services.

VII. WARRANTY DISCLAIMER; LIMITATION OF LIABILITY

Warranty Disclaimer.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Assumption of Risk.
YOU UNDERSTAND THAT THE AI READINGS ARE INTENDED FOR ENTERTAINMENT AND INFORMATIONAL PURPOSES ONLY. YOU ACKNOWLEDGE THAT RELIANCE ON THE AI READINGS IS AT YOUR OWN RISK, AND WE CANNOT GUARANTEE THEIR ACCURACY OR COMPLETENESS.

Limitation of Liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STAR PATH OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

VIII. INDEMNIFICATION

You agree to indemnify and hold harmless Star Path and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of another.

IX. DISPUTE RESOLUTION AND GOVERNING LAW

A. Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services must be resolved exclusively through final and binding individual arbitration under the rules applicable to such arbitration in Texas, except as otherwise provided herein. You and Star Path waive the right to a jury trial and class or representative actions.

B. Special Notices for California and New Jersey Residents

If you are a California or New Jersey resident, you may have additional rights under applicable consumer protection laws. Please refer to the sections below for specific notifications required by law:

  • California Notice: California users may contact the Complaint Assistance Unit of the Division of Consumer Services at 400 R Street, Suite 1080, Sacramento, CA 95814, or call (916) 445-1254 or (800) 952-5210.
  • New Jersey Notice: The sections on indemnification and limitation of liability do not apply to New Jersey residents to the extent required by New Jersey’s Truth-in-Consumer Contract, Warranty, and Notice Act.

C. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought exclusively in the appropriate state or federal courts located in Texas.

X. MISCELLANEOUS

  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights without notice.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Star Path regarding your use of the Services.
  • Force Majeure: We shall not be liable for delays or failures to perform due to events beyond our reasonable control, including acts of God, war, terrorism, or other events.
